How much is flight overbooking compensation? Rules? How to get it?
If an airline sells more tickets than there are seats, it’s called “flight overbooking”. It is done to ensure that there are no empty seats at take off. Overbooking helps airlines to maximize the capacity of the flight. And airlines can earn more, too. But there are situations when everyone shows up for their flight. Then passengers can be denied boarding.
And the airline is obliged to pay UK/EU denied boarding compensation.
There are two ways you can claim this compensation.

If you’re flying with TUI, and you are denied boarding due to overbooking — you are entitled to flight overbooking compensation (UK/EU denied boarding compensation) up to €600. This applies to all TUI flights. When flying with TUI, you are protected under the UK and EU laws.
Remember — this only applies to overbookings.
The UK and EU regulations apply only to situations when you are denied boarding due to overbooking. You won’t be entitled to denied boarding compensation if you are refused to board the plane due to visa and passport issues, or if you voluntarily give up your seat.

1.1 Voluntary Denied Boarding
What is voluntary denied boarding?
Yes, there are different types of denied boarding.
There is involuntary denied boarding, and there’s voluntary denied boarding. The latter one is when you accept to be denied boarding. When there are no seats on the plane due to overbooking, the airline will look for volunteers who will want to travel later, on a different flight. The airline will make an offer of instant compensation (in form of coupons or cash) and other perks such as a free hotel stay. It’s called voluntary boarding denial.
If you accept the airline’s offer and travel later, in this case, you aren’t entitled to denied boarding compensation from TUI.
You don’t have to agree to an offer like this.
1.2 Involuntary Denied Boarding
There are situations when passengers don’t have a choice.
If there are not enough volunteers, some passengers with confirmed tickets can get bumped from the plane involuntarily. If that’s what has happened to you, know that it’s called involuntarily denied boarding, and you will be eligible for compensation.
What happens in case of involuntary denied boarding?
- The airline must provide you with a new flight or give you a full refund for the flight;
- In addition to that, you are entitled to receive care from the airline*;
- You are entitled to compensation up to €600 per passenger.
* TUI must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If you have to wait overnight, TUI must provide you with free accommodation and free transfer from and to the airport.
1.3 Right to Care
All passengers travelling with TUI have a right to care.
You have been denied boarding by TUI (voluntarily or involuntarily, it doesn’t matter). As a result, you have to wait at the airport for your replacement flight. According to the EU/UK regulations, TUI has to provide you with certain services for free. As long as the waiting time is 3+ hours.
What does it mean for you as a passenger?
TUI must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If your new flight is leaving on the next day, free accommodation and free transfer must be offered by TUI. Contact the airline if you haven’t been offered anything.
You are entitled to care from TUI also if your TUI flight has been delayed or cancelled. No matter the circumstances.

2.1 How Long Does It Take?
It’s not a fast process.
Most people receive compensation in a few months. It could also take less time — something like 2-3 months. Each case is different. If the airline cooperates, it will be more like 2-3 months. If it doesn’t, it will be more than that.
If the airline doesn’t cooperate or it refuses your claim, you will need to work with a national enforcement body or take your case to court. If this is the case, it will take months until you receive your TUI denied boarding compensation.
As you can see, this process can take a lot of time. Hence the reason why most people choose to work with flight compensation companies. Not that it’s very difficult or requires a lot of paperwork (mostly it’s a pretty easy process). It just takes time and you have to be persistent. 3. How Much Can You Claim?
In the EU and the UK compensation amounts are fixed.
In most situations they range from €250 to €600.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).
3.1 TUI Voucher Code, Discounts or Cash?
According to the law, compensations have to be paid in cash or by bank transfer.
TUI, just like most airlines, may initially offer you a TUI voucher refund instead of money. Request a bank transfer instead. Because all airline compensations and refunds in the EU/UK have to be paid in cash or by bank transfer.
TUI Denied Boarding Compensation: FAQ
My flight was cheap. Can I still get compensation?
Yes.
The price of your ticket has no influence on this. If you are entitled to compensation, you can get it even if your ticket cost €10. If you are entitled to €600 compensation for the delay, you will get €600, even if it was a very cheap ticket.
Do I need to have travel insurance in order to claim compensation?
No, you don’t.
These are two separate things.
You can claim compensation even if you don’t have insurance. According to Regulation EC 261/2004 (and Regulation UK261), passengers can get compensation if their flight has been heavily delayed due to the fault of the airline. It doesn’t matter if they have insurance or not.
Can my child/baby get compensation from TUI?
Yes.
The age of the passenger doesn’t matter. Kids and babies can get compensation, too. Even infants who have a special infant ticket. If you are entitled to compensation of 600 euro, your child/baby will be too.
These are the laws in the EU and the UK.
Can I claim compensation for my friend, relative, family member?
Yes, you can.
Even if you weren’t on that flight yourself.
Ask your friend/family member to provide with their passport copy and boarding pass. They will also need to sign any documents the airline will ask to sign. If you decide to work with a flight compensation company, in most cases there’s only one document to sign.
Can I claim compensation for old flights?
It depends on the laws of the country.
In most cases, in Europe, you can claim TUI compensation even for old flights that were 2-3 years ago. However, for the best results, we would recommend you to make a claim as soon as possible.
What to do if TUI is refusing to pay compensation?
TUI is refusing to pay compensation even though you are entitled to it.
What to do in such a situation? The best way is to hand over your case to a flight compensation company and ask them to help.

Problems With Visa or Passport
I was denied boarding due to issues with my visa / passport. Can I receive denied boarding compensation because of that?
No, it’s a 100% no.
The European regulations only cover overbooking.
If you don’t have the right visa, it’s your fault. If your passport is about to expire, it’s your fault you didn’t notice that before your flight. You made a mistake. You can’t ask airline to pay you compensation for your mistakes.
EU – Non-EU Flights, Regulation UK261, Tourists
I’m flying to the EU from a country outside the EU. Can I get compensation?
If you’re flying with TUI, then yes, you can.
Even though TUI is a British airline, you are protected. When your TUI flight is departing from a country outside the EU (including the UK), you are protected under the UK Regulation UK261. Otherwise, you are protected by the EU Flight Compensation Regulation 261/2004.

Then yes, you can.
I am not a European. Can I get compensation?
Yes.
The UK and EU regulations protect all passengers — both tourists from overseas and Europeans alike.
Other Situations
TUI provided me with a free hotel stay and a free replacement flight. Can I still get compensated for the delay?
Yes.
As long as you are entitled to compensation, you can get it even if you were provided with a free hotel stay and replacement flight. A free hotel stay and replacement flight doesn’t affect your chances of receiving this compensation.
TUI took me to my destination. Can I still get compensation?
You might.
If you arrived at least 3 hours later than scheduled, and the delay was due to the fault of the airline, you can get compensation. Even if you were given a new ticket to your destination.
