EU and UK flight compensation regulations are almost identical. According to these regulations, you are entitled to compensation, if you reach your destination at least 3 hours later than scheduled, and the delay is due to the fault of the airline.

If you’re flying to or from Europe, your flight is delayed for 3+ hours, and the delay is due to the fault of TUI, you might be eligible to compensation of up to €600. If your flight is with a non-EU/UK airline (Qatar Airways, Qantas, etc.), it applies only to flights departing from the EU/UK.

Could you be entitled to TUI flight delay compensation?

Yes, if:

  • It’s a 3+ hour delay;
  • It’s due to the fault of TUI;
  • Flight is to/from Europe.

TUI is a British charter airline. Even though it’s not a EU airline, you are still protected in case of delay, cancellation and denied boarding. In some cases, you will be entitled to compensation, too. It is because there’s a regulation in the UK (Regulation UK261) which protects air passengers travelling to/from/within the UK. It is very similar to the EU regulation (EC No 261/2004).

Are you protected, if it’s a charter airline?

Yes, EU/UK regulations also apply to charter airlines, including TUI. So, all the above mentioned rules apply to all TUI flight delays and cancellations.

By Europe and EU here on this page (and on this website in general) we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin (French Antilles), the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

1.1 Extraordinary Circumstances

There are situations when you aren’t eligible for compensation. For example, flights delayed due to “extraordinary circumstances” are not eligible to compensation. 

Extraordinary circumstances are events outside of the airline’s control. These are bad weather, nationwide strikes, terrorism threat, civil unrest, natural disasters and security issues at the airport. If your flight is delayed or cancelled due to any of these events, you can’t get European flight delay compensation.

What about strikes? Speaking of strikes, in some situations you still can get compensation. As long as it’s a strike of TUI employees, you might be entitled to compensation. One more thing to remember is that not always airlines are telling the real reason for delay. That’s why when in doubt, double-check what you’re told. 

Because often airlines hide the real reasons for delays and cancellations. It is done to avoid paying compensation. What really matters is the time of arrival to your destination.

Not the time of departure, but the time of arrival in your destination.

Flight delay time is calculated based on the actual time of arrival to your destination, specifically, when the doors of the airplane are opened. If the doors are opened 3 or more hours after the original arrival time, you can get TUI flight delay compensation.

If you have a connecting flight, see how much later you arrive at your final destination. Do not calculate delay time according to departure time or arrival time of individual flight leg. In Europe you also have a right to care.

If you have to wait more than 3 hours, you are entitled to care from TUI.

TUI must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If the flight is delayed overnight, you should be offered accommodation and transportation from and to the airport as well. In Europe all passengers are eligible for this type of care from the airline.

2. How to Claim TUI Compensation For Delayed Flight?

There are two ways you can do it online.

One of the options is to contact TUI yourself. Call TUI customer support center or use the contact form on their website. Request TUI flight delay compensation. Refer to the EU/UK Regulation 261 when claiming TUI compensation. Give all the details about your flight, including the delay time and reason for delay. Keep in mind that it might take months to get delayed flight compensation from TUI.

2.1 How Long Does It Take?

No matter how you proceed, it isn’t a short process. 

It could take 2-3 months. Or it could take more than that. Every case is different. If the airline is not cooperating or is refusing your claim, you will have to hand your case to a national enforcement body or even lawyers. It will add at least a couple of months, or more.

3. How Much Can You Claim?

The compensation amount is fixed and range from €250 to €600.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 TUI Voucher Refund or Cash?

You might be offered a voucher or coupon instead of compensation.

Majority of airlines were offering coupons during the COVID crisis. 

What if you are offered TUI voucher refund or TUI voucher compensation? Do you have to accept it? No, you don’t. Compensations and refunds in the EU/UK have to be paid in cash of by bank transfer.

4. Your Flight Is Delayed. Should You Wait at Home or Hotel?

Your TUI flight is delayed. You see the flight status online.

Should you stick to your original plans and go to the airport?

It depends. If the check-in is delayed too, it is better to wait at home or hotel. If the check-in is not delayed, it is better to proceed as normal.

5. TUI and Regulation UK261

TUI is a British airline.

After Brexit, a new law has been brought into force — the Regulation UK261. It is similar to the EU Regulation 261/2004. It states that in certain situations you are entitled to compensation, just like you would in the EU. The laws and rules in the UK regarding flight disruptions are very similar to those in the EU. 

The only real difference is that you will be paid in Pounds Sterling.

And, just like in the EU, in the UK, you are entitled to a right to care. 

Keep in mind that TUI also has subsidiaries in the EU. They are regulated by the EU law. And if you are experiencing a delay or cancellation with these airlines, you can get compensation in accordance with the EU Flight Compensation Regulation 261/2004.

My flight was cheap. Can I still get compensation?

Yes.

The price of your ticket has no influence on this. If you are entitled to compensation, you can get it even if your ticket cost €10. If you are entitled to €600 compensation for the delay, you will get €600, even if it was a very cheap ticket.

Do I need to have travel insurance in order to claim compensation?

No, you don’t. 

These are two separate things.

You can claim compensation even if you don’t have insurance. According to Regulation EC 261/2004 (and Regulation UK261), passengers can get compensation if their flight has been heavily delayed due to the fault of the airline. It doesn’t matter if they have insurance or not.

Can my child/baby get compensation from TUI?

Yes.

The age of the passenger doesn’t matter. Kids and babies can get compensation, too. Even infants who have a special infant ticket. If you are entitled to compensation of 600 euro, your child/baby will be too. 

These are the laws in the EU and the UK.

Can I claim compensation for my friend, relative, family member?

Yes, you can.

Even if you weren’t on that flight yourself.

Ask your friend/family member to provide with their passport copy and boarding pass. They will also need to sign any documents the airline will ask to sign. If you decide to work with a flight compensation company, in most cases there’s only one document to sign.

Can I claim compensation for old flights?

It depends on the laws of the country.

In most cases, in Europe, you can claim TUI compensation even for old flights that were 2-3 years ago. However, for the best results, we would recommend you to make a claim as soon as possible.

What to do if TUI is refusing to pay compensation?

TUI is refusing to pay compensation even though you are entitled to it.

If you’re flying with TUI, then yes, you can.

Even though TUI is a British airline, you are protected. When your TUI flight is departing from a country outside the EU (including the UK), you are protected under the UK Regulation UK261. Otherwise, you are protected by the EU Flight Compensation Regulation 261/2004.

Then yes, you can.

I am not a European. Can I get compensation?

Yes. 

The UK and EU regulations protect all passengers — both tourists from overseas and Europeans alike. 

Other Situations

TUI provided me with a free hotel stay and a free replacement flight. Can I still get compensated for the delay?

Yes.

As long as you are entitled to compensation, you can get it even if you were provided with a free hotel stay and replacement flight. A free hotel stay and replacement flight doesn’t affect your chances of receiving this compensation.

TUI took me to my destination. Can I still get compensation?

You might.

If you arrived at least 3 hours later than scheduled, and the delay was due to the fault of the airline, you can get compensation. Even if you were given a new ticket to your destination.
